This event is part of a weekly series sponsored by the Access to Justice Institute, the Social Justice Coalition, the Student Bar Association and the Center for Global Justice.

April 2014

Division II of the Washington Court of Appeals recently affirmed a summary judgment secured by Winterbauer & Diamond on behalf of a large regional employer. The lower court decision dismissed claims for disparate treatment based on disability, hostile work environment, unlawful retaliation, and failure to provide reasonable accommodation.

Winterbauer & Diamond is pleased to announce that Rachel Emens, a summer legal intern with the firm, has been named co-recipient of the Mary Ellen Krug Scholarship. This scholarship is awarded to law students who have shown ability and interest in employment and labor law. Ms. Emens first joined the firm as a litigation assistant in 2007. She will graduate from Seattle University School of Law this December.

Secured favorable arbitral ruling upholding discharge of commissioned law enforcement officer for exceeding authority and exercising poor judgment in role as School Resource Officer.

April 2012

Prevailed on summary judgment in representation of regional retail employer against former employee’s claims for religious discrimination and discharge in violation of public policy.

March 2012

Represented an employer in a class action case alleging employees were being misclassified as exempt outside sales representatives and thus improperly denied minimum wage, overtime payments and meal and rest breaks. The case was resolved through mediation and settled on a class-wide basis.

August 2011

Defended multi-state medical insurance provider against former employee’s claims of discharge in retaliation for exercising rights under the federal Family and Medical Leave Act. Based on evidence secured through discovery and under threat of motion for summary judgment and sanctions, plaintiff voluntarily dismissed claim with prejudice.

June 2011

Winterbauer & Diamond PLLC celebrates 15 years of serving employers in the Pacific Northwest.

May 2011

Represented Fortune 100 company against former employee’s discharge-related claims, including breach of contract, negligence, retaliation, discharge in violation of public policy and discrimination based on gender and disability. With defense motion for summary judgment pending, plaintiff voluntarily dismissed all claims with prejudice.

February 2011

Represented a national drug store chain against claims of age discrimination, discharge in violation of public policy, and discharge in retaliation for asserting violations of state and federal wage/hour law. The Court dismissed the case on a defense motion for summary judgment and awarded sanctions.
